Terms & Conditions of Use
These Terms & Conditions govern the use of this website and all quotations, bookings, payments, and travel arrangements made with Africanova Travel CC (Registration No. 2010/107688/23), trading as Africa Nova Travel (“Africa Nova Travel”, “we”, “us”, “our”).

By accessing this website, requesting a quotation, confirming a booking, or making any payment, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.

1. Intellectual Property
All content published on this website, including but not limited to text, images, graphics, logos, icons, layouts, designs, colour schemes, and trademarks, is owned by or licensed to Africanova Travel CC and is protected by South African and international intellectual property laws. No content may be copied, reproduced, distributed, modified, or used without prior written consent.

2. Website Disclaimer
This website and its content are provided on an “as is” and “as available” basis. While Africa Nova Travel takes reasonable care to ensure accuracy, we make no representations or warranties, express or implied, regarding the completeness, reliability, accuracy, or availability of the website or its content. Africa Nova Travel, its members, employees, agents, and associates shall not be liable for any loss or damage of any nature arising from the use of, or inability to use, this website or the information contained herein, whether direct, indirect, incidental, consequential, or otherwise, to the maximum extent permitted by law.

3. No Offer – Invitation to Do Business
The information contained on this website constitutes an invitation to do business and does not constitute an offer. No binding contract shall exist until a booking has been confirmed in writing by Africa Nova Travel and the required payments have been received in cleared funds.

Africa Nova Travel does not control, monitor, or endorse such content or websites and accepts no responsibility for any unlawful, inaccurate, defamatory, or inappropriate material contained therein. Users are encouraged to notify Africa Nova Travel of any illegal or offensive content accessed via links on this website so that appropriate action may be considered.

5. Pricing Accuracy
Africa Nova Travel strives to ensure that pricing information displayed on this website is current and accurate. However, due to seasonality, availability, supplier changes, and exchange rate fluctuations, prices shown are indicative only and subject to change. Final pricing will be confirmed at the time of quotation and booking confirmation.

6. Booking and Payment Terms
All bookings with Africa Nova Travel are subject to confirmation in writing and receipt of the required payments in cleared funds. A non-refundable deposit of 30% of the total booking value is required to confirm any booking. Some suppliers may require higher deposits, which will be communicated in writing. The balance of payment is due no later than 60 days (8 weeks) prior to the commencement of travel. Bookings made within 60 days of departure require full prepayment at the time of confirmation. Failure to make payment within the required timeframe may result in cancellation and applicable penalties.

7. Currency, Exchange Rates and Bank Charges
Services supplied within South Africa are quoted in South African Rand (ZAR). Notwithstanding the quotation currency, Africa Nova Travel invoices and charges clients and/or agents in United States Dollars (USD). Where applicable, ZAR amounts are converted to USD at the prevailing exchange rate on the date of invoicing or receipt of payment, as determined by Africa Nova Travel’s bank or authorised payment processor. The exchange rate applied is final and binding. Services supplied outside South Africa, including Southern Africa, East Africa, and the Indian Ocean Islands, are invoiced in USD or EUR, as specified. All bank charges, correspondent fees, intermediary fees, and currency conversion costs are for the account of the payer. Any shortfall remains payable. Africa Nova Travel does not add local taxes. Any applicable local taxes or levies are included in supplier rates. Clients and agents remain responsible for tax obligations in their own jurisdictions.

8. Flights and Airfare
All flights are subject to airline fare rules and conditions. Full payment (100%) is required at the time of booking flights. Copies of all passengers’ passports must be provided prior to ticket issuance. Passenger names must match passport details exactly. Airlines generally do not permit name changes once tickets are issued. Airline tickets are generally non-refundable and non-changeable; however, certain fare classes may allow changes or partial refunds strictly in accordance with airline rules. Africa Nova Travel accepts no responsibility for airline delays, cancellations, schedule changes, overbooking, or airline insolvency.

9. Changes and Amendments
Any amendment to a confirmed booking is subject to availability and re-quotation. Additional costs or penalties may apply. Africa Nova Travel reserves the right to substitute comparable services where operationally required.

10. Cancellations and Refunds
Cancellation charges may apply and can be up to 100% of the total booking value, depending on timing and supplier rules. Unless supplier-specific terms override, standard cancellation charges may include:
• Cancellation more than 8 weeks prior to travel: loss of 30% deposit
• Cancellation 8–4 weeks prior to travel: up to 50% forfeited
• Cancellation less than 4 weeks prior to travel or no-show: up to 100% forfeited Refunds are subject to supplier and airline policies and will only be processed once funds have been recovered. No refunds are provided for unused or partially used services.

11. Travel Insurance
Comprehensive travel insurance is mandatory for all travellers. Insurance must include, at a minimum, medical expenses, emergency evacuation, repatriation, cancellation, and personal liability cover. Failure to obtain adequate insurance is at the traveller’s sole risk.

12. Passports, Visas and Immigration
Travellers are solely responsible for ensuring compliance with passport, visa, vaccination, health, and immigration requirements of all destination and transit countries. Passports must be valid for at least six (6) months beyond the date of return and contain two consecutive blank pages. Yellow fever vaccination certificates may be required depending on country of origin or transit. Some destinations carry a malaria risk; travellers are advised to seek medical guidance. Minors travelling to or from South Africa may require additional documentation, including unabridged birth certificates and parental consent affidavits. Africa Nova Travel accepts no liability for denied boarding, refusal of entry, detention, deportation, or related costs.

13. Limitation of Liability
Africa Nova Travel is not liable for acts or omissions of suppliers or third parties. Travel involves inherent risks, including wildlife encounters, remote locations, and limited infrastructure, which travellers voluntarily assume. To the maximum extent permitted by law, any liability imposed on Africa Nova Travel is limited to the amount actually received by Africa Nova Travel for the relevant services, excluding supplier payments. Africa Nova Travel shall not be liable for indirect or consequential damages.

14. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the Republic of South Africa. The courts of the Republic of South Africa shall have exclusive jurisdiction over any dispute arising from the use of this website or services provided by Africa Nova Travel.

15. Master Terms & Conditions
These Website Terms summarise key conditions only. All bookings are governed by Africa Nova Travel’s full Master Terms & Conditions, which are incorporated by reference and provided with quotations, invoices, and booking confirmations.

16. Changes to These Terms
Africa Nova Travel reserves the right to amend these Website Terms & Conditions at any time without prior notice. Continued use of this website constitutes acceptance of the updated Terms & Conditions.
